I dunno about this. They received an alert. They replied to stop the alerts. They received a confirmation the alerts would stop (which they complained about as well). The complaint doesn't say there were any further messages, just those two.
How long had the cell phone user had that phone number? I've had to use some pay-as-you-go cell phones at times and in most cases I either get phone calls or text messages for the person that previously had the number that was assigned to me. Did the previous owner of that number subscribe to the alerts and didn't unsubscribe?
They do claim TWC was sending using an automated random number device, but do they have proof of that?
No one makes a lot on class action suits (except the attorneys). Just sounds like another way to make a lawyer richer, "stick it to corporate America" and take time away in our legal system from cases that really need attention. In other words... frivolous law suit.
